Many businesses put off having individual accurate Terms and Conditions and Contracts until they have had a problem. They have to go through all that wasted time, effort and worry when it could easily have been avoided. Documents off the Internet or documents used for many years are rarely fit for purpose in today’s commercial world.
Contracts are so much more than the goods/services and the price. Are both parties agreeing the same thing?
So often this is not the situation.
If there is a dispute and no Contract or Terms and Conditions it can all very quickly become very time consuming and expensive to resolve.
What We Do
Work with you to establish exactly how you want your business to run at each and every stage so it reflects your Brand.
Encourage you to reflect on all the problems you have had and work out how to avoid a repeat.
Stress the importance of having procedures and documents that are practical , specific to your business and work for you.
Look at your contracts and discuss with you so they say what you intend them to mean. The English language can have many interpretations. Make sure you have the right one and avoid unnecessary misunderstandings.
Draft you readable Jargon free documents that you and your Clients can and will read.
Use precise, plain simple language. The legal effect is the same as long tedious documents. It is often better because our documents can be read and disputes avoided.
What We Do Not Do
Provide unnecessarily long documents.
Use lots of impenetrable Jargon.
Feel the need to offer long definitions of words that are obvious.
Your business will evolve and so must your Terms and Conditions and Contracts.
Good clear documents will help you develop good Client relationships leading to increased profits.
If you are unsure about your existing Terms and Conditions and Contracts we are happy to review these for you.
Clients wanting to appoint Agents but found agreement had not referred to correct law for Agents so unenforceable.
We were able to draft an agreement that complied with the current law.
Invoice not paid then when it was chased there was an argument over the quality of the goods supplied. Problem over what exactly the goods were as both parties had a different view.
We advised on how to resolve this problem and drafted contract to use in the future.
There was a delay in delivery through no fault of the Supplier but their client wanted to cancel.
Could they? We were able to advise them on their rights and draft Terms and Conditions to avoid such arguments in the future.
